Terms and conditions & Complaints procedure

Fast Encash Money Transfer Services Ltd (normally referred as Fastencash) is a limited liability company registered in England and Wales. Fastencash is regulated by HM Revenue and Customs (HMRC) under the Money Laundering Regulations as a Money Service Business (Registration No: 12530195) and by the Financial Conduct Authority (FCA) as an Authorised Payment Institution (Ref No: 519669)
Fastencash shall provide the “Service” for the “Customer” in accordance with these Terms and Conditions and this shall constitute the entire agreement between the “customer” and the Fastencash save and except where the same is specifically varied by agreement and in writing. As such the Terms and Conditions are to be synonymous with the term “Customer Agreement”
These Terms and Conditions apply to all dealings that you have for sending money using website or at any of our Branches. The use of any of the service will constitute your express acceptance of our Terms and Conditions.
Please read and understand these Terms and Conditions before you accept them. Failure to observe the Terms of Conditions of the Agreement with us has legal consequences.
Fastencash reserves the right to change the Terms and Conditions from time to time in which event notification of any change will be posted on our website in a clear and readily accessible manner. It shall be your duty to properly acquaint yourself with the updated Terms and Conditions which shall at all times apply from the date of publication until deletion, substitution or amendment.
Remittance services of Fastencash Fastencash remittance service allows its customers in the UK to send money face to face at its branches and also through its website.
Remittances are processed upon receipt of the amount involved from you. In case payment for remittances are made by Bank transfer or Debit cardthe account holding bank or the card issuing bank may charge for this service. Any charge raised by the Bank for providing their service is a separate agreement with them respectively and does not affect the agreement as between the Fastencash and you the customer.
Funds will usually be available for collection by the beneficiary within 30 minutes of your transaction being authorised after the transaction being authorised in cases where the beneficiary chooses to collect the amount in person from our Agent in the country of destination. In case where you chose to have the amount credited to the bank account of the beneficiary it may take 2 – 3 days after the transaction is authorised and released by us. This however is subject to the opening days/hours and time zone difference of the pay-out destination.
We will only accept your payment towards remittances to me made only in British Pounds (GBP). We will convert the amount to be remitted to the currency of the destination country at our rate of exchange.
Our exchange rate can change at any time without prior notice. Information about the exchange rate is available on our website or can be obtained by calling our telephone helpline number 02085521808. The exchange rate quoted is applicable for real time only.
Availing our Service Our services are made available either from our branches or through our website. Access to our website is free but you must be over the age of 18 years to initiate instructions through the website.
Before accepting instructions from you we require evidence that you are of appropriate age and qualification.
The website contents may change without notice and Fastencash does not warrant or guarantee that either the website or its contents will be available all the time
Fastencash may discontinue or modify the service or any part of it without notice and at any time.
Fastencash retains the absolute discretion to refuse any transaction requested by you
Fastencash will use its best endeavours to process transactions promptly, however some transactions may be delayed or cancelled for a number of reasons including but not limited to our efforts to verify youridentity, to validate your transaction instruction, to contact you, or to comply with applicable law or due to variations in business hours.
You agree that in connection with your use of our services, or in the course of your interactions with us, you will not:
Breach this Agreement, or any other agreement between us;
Create/attempt duplicate registrations in the same name;
Provide false, inaccurate, or misleading information; and
Refuse to cooperate in an investigation or provide confirmation of your identity or any other information requested by us.

RegistrationRequirements All applicants wanting to use our service are required to complete a formal registration form. For those using on line service the foam will be available in the site, for others the form will be available at our branches. Registration requires acceptance of these Terms and Conditions.
In case of using the website for registration you will be provided with “log in” details and be required to select or be assigned a personal “password”. Once your Registration has been accepted you are obliged to ensure that any “log in” detail and or password, picked or allocated are treated with the strictest confidence and are in no circumstances to be divulged to any third party.
The Fastencash will without any notification have the right to “disable” any “User” and to remove their “Credentials” at any time if in the opinion of the Fastencash, the “User” has breached any of these conditions or misused the system.
Passwords: If at any time your identification code or password is or you suspect that it has been compromised you MUST contact Fastencash immediately. The Customer shall notify Fastencash in the event that it becomes aware or reasonably believes that its servants and or agents or any third party has acted in breach of these terms and must take positive measures to prevent the continuing breach.
n the event that Fastencash suffers loss and or damage as a result of any breach as described or at all, including damage to reputation, Fastencsh reserves the right to seek damages and or compensation.
In compliance with legal requirement, regulation, code of conduct or any other similar requirement of a relevant professional body or authority we may ask you provide us with information and to supply documents relating to yourself and or any beneficiary. It is a condition precedent to this agreement that such requests must not be unreasonably refused and Fastencash will not action your instruction unless and until such time as the requested information is received.
5.You must complete the remittance request form duly completed to us with appropriate identification, pay the amount being remitted to us or to an accredited “FASTENCASH” branch or to an accredited agent during normal business hours.
5.1 The principal amount/s to be remitted will be converted at our exchange rate for the currency vis a vis the currency of payment/redemption effective at the time of transaction.
5.2 Right to accept transaction: We are not obliged to accept your application for a remittance and have the right to decline your request for any reason. If accepted we will only make the remittance payable to a designated recipient/beneficiary and payable in the manner stipulated in the remittance form.
5.3 If the designated recipient /beneficiary is not a natural person remittance for cash payments will not be made. Such payments will only be made by credit to bank account only.
5.4 Information on remittance details: You receive the full information on the remittance once the remittance transaction is accepted and put through by us. You are responsible for informing the required details to the beneficiary/recipient if you yourself are not the beneficiary/recipient.
5.5 All interest, if any, and foreign exchange gains will be for our account
5.6 Remittances are not guaranteed: The facility of remittances offered by us is an unsecured obligation and is not guaranteed by any person/s
6. If the remittance is for redemption/payment by way of cash at destination, the designated beneficiary/recipient must present himself/herself in person, furnish the reference details of remittance, complete the form applicable, and provide appropriate identification to an accredited agent of “FASTENCASH” during normal business hours at place of destination
6.1 It is your responsibility and also the responsibility of the designated recipient/ beneficiary to protect the confidentiality of the Remittance details. We will be within our right and entitlement to redeem/pay the remittance in favor of any person who satisfies the steps set out above, regardless of whether or not that person is the named designated beneficiary/recipient
6.2 Redemption of remittance: When all the requirements set out in 6. above are satisfied and complied with, the person presenting before the accredited agent of Fast Ancash with the details may redeem the remittance. No further redemption of remittance will be valid and will not be entertained.
6.3 Currency of redemption/payment: Unless otherwise agreed and specified in the remittance details all remittances will be paid/redeemed in the currency of the country of destination.
6.4 Payment to/redemption by wrong person: If any remittance is paid/redeemed in favor of a person who is not the actual designated beneficiary/recipient of the subject remittance, but who we/our agent believed, on our reasonable grounds, was the designated recipient/beneficiary, we will not be liable to you or to the Designated receiver/Beneficiary and we will not have any obligation to pay/redeem the remittance any further.
6.5. Unclaimed/Unpaid remittances: If a remittance has not been paid/redeemed within six months from the date the remittances was made we will make reasonable efforts to contact you (using the contact details you have given in the remittance application form) to arrange payment of the principal amount less our administrative costs and foreign exchange loss/difference on account of reconversion of the amount back to the currency paid by you at the time of remittance.
6.6 Events beyond our control: We are not required to carry out any of our obligations referred herein, if it is not reasonably practical for us to do so because of any event/beyond our control.
7. Remittances for deposit to bank account: If you have instructed us to deposit the amount of remittance into a bank account of the beneficiary/recipient giving the bank account details, we may accept the same subject to the following terms:
(a) You are responsible for providing the correct account and bank details and we rely on the account number provided while making the remittance. In case of any charges levied by the service providers at the destination country due incomplete details or incorrect details etc we reserve our right to deduct such charges from the principal amount.
(b) Any charges if any payable to the service provider for such deposits are to be borne by the beneficiary/Recipient
(c) Service delivery times will not be met if the service provider cannot process the payment whether due to incorrect account details or for any other reason.
(d) We accept no further responsibility after the amount has been credited /deposited into the designated account number specified by you in the remittance application. We will not be liable to you or to the designated beneficiary/recipient or any other party, and we do not have any further obligation to recover the money from the account it is paid /deposited in accordance with your instructions
8. Enquiries: If you require any additional information about any specific destination countries or if you have any problem in getting the remittance redeemed/paid to you/designated recipient/beneficiary you should contact the accredited agent of FASTENCASH in the country concerned.
9. Limitation of our liability: Our liability to you and the designated recipient/beneficiary in respect of a remittance is restricted to payment/redemption of the principal amount (minus any exchange loss if applicable). We are not liable for any loss, damage, cost, claim, delay etc whether direct (including loss in profit) or indirect consequential or special and whether due to our negligence, breach of contract, breach of any other obligation which we owe to you or for any other reason to the maximum extent permitted by law.
10 Indemnity: You will indemnify us against any loss, damage, cost, claim or liability incurred by us due to any breach by you of these terms and conditions or in respect of a designated recipient/beneficiary in connection with the remittance.
11 Termination: Clause no 9&10 will survive termination of the agreement between you and us relating to the remittance.
12. Entire agreement: These terms and conditions together with the remittance form completed and remittance confirmation if any issued to you constitute the entire agreement between you and us relating to the remittance
13 Governing Law: These terms and conditions will be governed by, and construed in accordance with the laws of England
14. Privity of Contract: You acknowledge that where you are not the designated recipient/Beneficiary, these terms and conditions are not intended to create an obligation or any other rights enforceable by the designated recipient/beneficiary against Fastencah money transfer services ltd.
15. Personal information: You confirm that the personal information provided by you to us in the remittance application from is correct and that we have relied on the said information to provide the remittance service to you and any other related purposes related to the provision of remittance services
16 Lawful purposes: You confirm that the remittance proceeds are being used for useful purposes only.
17 Definitions: Unless otherwise stated the following definitions, swill apply
(a)Accredited Fastencash agent: Means any outlet duly authorized by Fastencash money transfer services ltd to provide remittance services to the public as an agent.
(b)Designated recipient/Beneficiary: means the designated recipient/Beneficiary of the remittance nominated by you to receive the money either in cash from the agent or through the credit of a bank account
(c)Designated bank account: means a bank account maintained by the designated recipient/Beneficiary in any bank in the country of destination.
(d)Events beyond our control: means any event beyond our reasonable control including, but not limited to, earthquake, cyclone, storm, flood, fire, disease frost, snow, other act of god, war, act by public enemy, civil commotion, loss of telecommunication or other utility eservices, banking failure, strike, lock out or other industrial action and any other general disruption
(e) “We” or “us”: means Fastencash ltd, and includes any employee, agent, contractor or any other person engaged by Fast encash money transfer services ltd in connection with the remittances facility, the word “ours” has a corresponding meaning
(f) “You” or “yourself”; means any person on whose behalf/request we have issued a money transfer instruction under these terms and conditions and where the context requires means any of those persons jointly and severally, and “Yours” has a corresponding meaning

19.Registration documentation: UK law requires all financial institutions to assist in the fight against financial crime, money laundering and terrorist financing activities by obtaining, verifying and recording information about customers. Fastencash requires you to provide us with original identification documentation to include a passport or driving licence or other form of photographic identification and an original utility bill, banking or official document, being less than 3 months old. We reserve the right to consult other recognised sources in order to obtain information about you. Your residential address and personal details will be verified to confirm your identity. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998. By agreeing to these Terms and Conditions you acknowledge and consent to Fastencash Privacy Policy which can be found on our website.
We reserve the right to provide information about you and your transaction to government authorities and law enforcement agencies if required by such government authorities and law enforcement agencies. The authorities prohibit us from accepting transactions with certain countries and individuals (the government authorities may from time to time may change their requirements) In those circumstances screening will take place of all transactions against the lists of names provided by various governments/International Agencies. Where any “match” is identified we are required to and we will investigate the “match” to ensure compliance with current legal requirements. We may require us to obtain additional identification and or further relevant information, which may delay the transaction process. There may be occasions when certain threshold levels of transactions made by you are reached (the level of which may vary from time to time). If this occurs we shall require from your other additional information either about yourself, the beneficiary, the relationship between you both and the source of funds. Again, if this information is not supplied to us in a satisfactory form we will be unable to provide you our service and may terminate your account and contract with immediate effect. We reserve the right at our discretion to refuse any transaction or to limit the amount to be transferred on any transaction. Any such refusal or limitation may be imposed on individual accounts, linked accounts, or on beneficiaries at our sole discretion. . We reserve the right at any time, and from time to time, to modify or discontinue the service (or any part thereof) with or without prior notice.
20.Confidentiality, privacy and Data protection We keep information passed to us confidential and will not disclose it to third parties except as authorised by you or required by law. In certain circumstances the law requires us to disclose information relating to you.
We may in some cases consult credit reference agencies in order to assess your creditworthiness. If you are an individual, we require your consent before we do this. Your continuing instructions to us will constitute your consent to us carrying out such a search. Details of the credit agency we use are available on request. We have procedures designed to ensure that personal data is used only by appropriately authorised and trained personnel and to safeguard such information against accidental loss or unauthorised disclosure. We will keep that information strictly confidential unless otherwise required by law or Court Order.
Data Protection: Weconfirm that we respect the data we hold on you. Your acceptance of these Terms and Conditions authorises us to keep your details on our database so that we can provide you with the Services and for administration and accounting purposes, so that we can make credit searches and send you relevant information on our services and on events that may interest you. All information that we hold concerning you as an individual will be held and processed by us strictly in accordance with the provisions of the Data Protection Act 1998. We will not, without your consent, supply your name and address to any third party except where:
* It is necessary as part of the services that we undertake; or
* We are required to do so by law or our professional rules.
If you are an individual, you have a right under the Data Protection Act 1998 to obtain information from us, including a description of the data that we hold on you. Should you have any queries concerning this right, please contact 02085521808 at our registered office.
On placing your instructions for money transfer Fastencaash will provide you with an acknowledgement/confirmation: This does not confirm acceptance of your order nor does it constitute an agreement to execute the request as presented. No contractual arrangement will exist between you and Fastencash until Fastencash accepts your instructions, the funds have been received by us and our Compliance Department have satisfied themselves in accordance with our policy, protocol and Money Laundering requirements.
21.Validation of Information provided by you If in any case we cannot confirm your identity to our satisfaction or where we have reason to believe that your instructions are incomplete, unauthorised or forged then we shall reject the instruction and the transfer will not be processed. If you are unable or unwilling when requested to identify the source of funds being sent or fail to supply any other information which we may request of you in order to comply with our legal requirements then we shall reject the instruction and the transfer will not be processed. If you provide us with incorrect or incomplete information or if your transaction message is not given to us sufficiently in advance to allow for timely provision of the requested transaction we shall reject the instruction and the transfer will not be processed. If we have reason to suspect that the monies being transferred represent criminal property, are linked to terrorist funding or are in any way in breach of Anti Money Laundering regulations or any other relevant law then we shall reject the instruction and the transfer will not be processed.
Fastencash will not accept any responsibility for any damages, costs or losses incurred due to payment being not made or delayed beyond our control (see our limitations to liability par………) or where we are acting in accordance with legal protocol, Code of Conduct, Regulation or Statute. We are not obliged to process any particular “Transaction”. We may, at our sole discretion, refuse any “Transaction” or set a limit to the amount to be transferred, which may be subjected to change.
Fastencash takes your security very seriously and will ensure that the information you have provided to us is kept secure. Consistent with that set out below we will not be liable of any breach of security.
You understand that we are obliged to keep all information in our database for up to 5 years, as required by the authorities.
22.Termination: We may without notice and without liability to you, terminate or suspend your account as provided below (but not limited)
* If a claim is received as to the ownership of the debit card used
* If any of the Terms and Conditions are breached
* If at any time we have reason to suspect that the transaction breaches the letter or spirit of these Terms and Conditions
* If at any time we have reason to suspect that you use the Service in a manner which Fastencash reasonably believes is illegal, offensive or which in the opinion of Fastencash is an abuse of the Service provided.
* If your account has been dormant for 6 months
* If you become insolvent. And or become bankrupt
* if you have a winding-up order made against it
Termination shall operate without prejudice to the accrued rights of either party.
23.Indemnity: You agree to defend, indemnify and hold harmless Fastencash, its affiliates and licensors and their respective officers, directors, employees, contractors, agents, licensors and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) resulting from your violation of these terms of use or your use of the website, including, without limitation, any use of the website's content or services other than as expressly authorized in these terms of use or your use of any information obtained from the website, or your negligence, fraud or wilful misconduct.
24.Communication through email and similar electronic means Computer and email security: Where you provide us with an email IDor similar electronic communication media for sending material to, we will assume, unless you tell us otherwise, that your arrangements are sufficiently secure and confidential to protect your interests. The email medium may not be secure and there are risks if you send sensitive information in this manner or you ask us to do so. Data we send by email is not routinely encrypted, so please tell us if you do not want us to use email as a form of communication with you or if you require data to be encrypted. We will take reasonable steps to protect the integrity of our computer systems by screening for viruses on email sent or received. We expect you to do the same for your computer systems. We may correspond with you by email unless you advise us in writing that you do not wish us to do so. You acknowledge that email may not be secure. Email will be treated as written correspondence and we are entitled to assume that the purported sender of an email is the actual sender and that any express or implied approval or authority referred to in an email has been validly given. You consent to us monitoring and reading any email correspondence travelling between you and any mail recipient at Fastencash. We will aim to communicate with you by such method as you request. More often than not this will be in writing, but may be by telephone if it is appropriate. We may need to virus check disks or e-mails, but unless you withdraw consent we may communicate with others when appropriate by e-mail or fax but we cannot be responsible for the security of correspondence and documents sent by e-mail or fax.
25.Limitation of Liability: Fastencash shall not be liable for any direct indirect or consequential loss damage or expense including but not limited to loss of data, use, or profits suffered or arising in any manner whatsoever out of or in connection with the Service or Fastencash’s termination of the Service for any reason whatsoever.
You are responsible for any chargeback, claim, reversal, fee, fine, penalty and other liability incurred by us, another user of our services, or a third party caused by or arising out of your breach of these terms of use, and/or your use of our money transfer Service. You agree to reimburse us, another user, or a third party for any and all such liability.
Except as otherwise required by law, the liability of Fastencash is limited to the GBP amount showing on the face of receipt for your money transfer transaction, including service charges. Except as provided in the previous sentence, in no event will the company, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under and legal theory, arising out of or in connection with your use, or inability to use, the website, any websites linked to it. Any content on the website or such other websites or any services obtained through the website or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
If the company does not properly complete transactions on time or in the correct amount in accordance with this agreement with you, Fastencash may be liable for your losses, up to the limitation described in the preceding paragraph. However, the company will not be liable if (a) through no fault of the company, you do not have enough funds available in your bank account, debit card account, or credit card account to complete the transaction; (b) the paying agent or recipient refused to accept your money transfer; (c) to complete the transaction; (b) the paying agent or recipient refused to accept your money transfer; (c) your funds are subject to legal process or other encumbrances restricting transfer; (d) you provide incorrect or incomplete transaction information to Ria; or (e) if your use is not an acceptable use.
The foregoing does not affect any liability which cannot be excluded or limited under applicable law.
Miscellaneous conditions: These Terms and Conditions constitute the entire agreement between yourself and GE and governs your use of the Service, superseding any prior agreements between us.
Our failure to exercise or enforce any right or provision of the Terms or Conditions shall not constitute a waiver of such right or provision. If any provision of the User Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give appropriately valid effect to the intention of the User Agreement as reflected in the provision concerned & the other provisions of the User Agreement shall remain in full force and effect.
We may modify or amend this Agreement from time to time without notice to you, except as may be required by law. You can review the most current version of the User Agreement at any time by accessing this website. You may terminate your use of the Service if you do not agree to any modification or amendment made to it. If you use the Service after the effective date of any modification or amendment you shall be deemed to have accepted that modification or amendment. You agree that you shall not modify or amend the terms of the User Agreement and you acknowledge that any attempt by you to do shall be void.
Complaints Procedure
1.Fastencash is committed to providing a fast and efficient service for its customers, and to keeping errors down to a minimum. In order to achieve this, the Bank uses the most up-to-date technology and employs well-trained, dedicated staff. Unfortunately, there may be occasions when we will fall below our own high standards, possibly a delay in processing a transaction or an error while processing a transaction. The Bank recognises the distress such an event can cause and has implemented a procedure designed to minimise the inconvenience to its customers. Fasten cash’s policy is to ensure that all complaints are treated fairly and sympathetically. In addition, complaints will be registered and monitored by an appointed person to ensure the customer is kept informed on a regular basis and that a final response is sent as soon as possible.
2.Making a complaint Should you have any query or complaint, please make a complaint by person at any of our branches or by email ( or by phone (0208 470 0821 or 07544389899) or in writing (to the Complains officer, Fast Encash, 144 High Street North, London E6 2HT) whichever is convenient to you. All these channels are monitored regularly by us to ensure that the complaints are addressed promptly.
* On receipt of your complaint we will record receipt of the complaint in our internal system.
* We expect to resolve the complaint within 2 days of receipt of your complaint and will get back to you within 2 days with the details
* In the event we are not able to resolve the complaint as mentioned above due to issues associated with retrieval of records, involvement of other agencies (such as Paying Banks at destination of payment or payment systems etc) or we need detailed investigation of the complaint we will acknowledge the complaint in wiring/ or by email to you
* Your compliant will then be investigated by the complaints section, to analyse and gather all documentation/information required in order to thoroughly and objectively conduct the investigation. This may require some additional information from you which the section will request you to provide.
* We will endeavour to communicate with you in a clear and fair manner at all times whilst investigating your complaint.
* During the above process we will keep you informed of its progress to date and whether there is any further information we require from you.  We will aim to deal with your complaint as quickly as possible.
* We will send you our final response within 4 weeks from the receipt of your complaint with full details of we have not resolved
* If you are not satisfied with our final response, you have the right to refer your complaint to the Financial Ombudsman Service, free of charge.
3.Financial Ombudsman's Service We are committed to resolving complaints through our internal complaints handling procedure. However, if it cannot be resolved to your satisfaction, then you may be entitled to refer it to the Financial Ombudsman Service ("FOS"). Further information on FOS are given below (
